British American Tobacco is one of the leading, multi-category consumer goods companies. It employs over 85,000 people, with market leadership in over 55 countries and factories in 42. The Group’s cigarette market share in its Key Markets continued to grow strongly (up 40 bps) in 2017. This was due to the comapny's GDBs, which grew 110 bps (ex US) and currently accounts for more than 50 percent of Group cigarette and THP volume outside the US. Over the year, market share in the US was up 20 bps, with the RAI Strategic Brands growing 40 bps. Total Group cigarette and THP volume grew 3.2 percent to 686 billion, or on an organic basis fell 2.6 percent, outperforming the industry, which was estimated to have declined by around 3.5 percent. Flagship THP, glo, first launched in Japan in December 2016, reached 3.6 percent market share by the end of 2017 – having been rolled out nationally from October 2017. The U.S. Food & Drug Administration announced that, for the first time, it has authorized the marketing of products through the modified risk tobacco product pathway. In 2019, British American Tobacco reported that its total cigarette and THP volume declined 4.4 percent to 677 billion sticks, with cigarette volumes down 4.7 percent and THP volumes up 31.6 percent. [[Philip Morris International]] and British American Tobacco have been caught drastically underreporting their production and even using their facilities to roll out black-market cigarettes. In a 2017 raid, Pakistani authorities found 1.3 million black-market cigarettes with the branding of a Philip Morris subsidiary in a van leaving one of the company’s former factories—which the tobacco giant was apparently using as an undeclared warehouse. That same year, Philip Morris International had reported a decrease in production, claiming competition from illicit manufacturers. According to research by Suzan Burton & Becky Freeman from The University of Sydney, former employees from British American Tobacco Australia and Philip Morris Internationl described incentives programmes whereby top performing retailers were taken on all-expenses paid vacations. According to two former employees of British American Tobacco Australia, these high-end experiential incentives were given to tobacco retailers who had achieved significant sales percentage ‘uplift’ during a promotional period. One participant provided the example that British American Tobacco Australia would run a promotion over a specified period of time whereby the tobacco retailers with the highest percentage uplift in Winfield sales (one of the major Australian tobacco brands) would go into a draw to receive an overseas all-expenses paid vacation. Tobacco companies would receive the sales data to measure performance through product scanning technology at point-of-sale, however, it was noted that data could not be easily obtained from ‘mom and pop’ type stores, making it difficult to include these stores in these incentive programmes. In August 2018, The Guardian reported that British American Tobacco has promoted sales of its cigarettes in some of the most fragile, war-torn and unstable countries of Africa and the Middle East. Documents acquired by The Guardian describe how cartons of cigarettes were distributed to traders hidden in black bags in Somalia after Al-Shabaab banned sales and threatened punishments under Sharia law between late 2008 and early 2009. New research co-authored by University of Bath details tax avoidance tactics used by the world’s four largest publicly-traded tobacco companies. British American Tobacco and Imperial Brands move large dividends and interest payments to holding companies in the United Kingdom. British American Tobacco  moves around UER 1 billion in dividends via Belgium each year but pays less than 1 percent tax on these profits. British American Tobacco and Imperial Brands UK subsidiaries have lowered their corporation tax burden by GBP 2.5-billion over the past decade. They have done this by offsetting losses made by one subsidiary against profit made by another. This is known as group relief. In August 2018 Uruguay became the first country in the region to enact plain packaging requirements for tobacco products. Only a month later, however, the decree was suspended due to a lawsuit filed by British American Tobacco. An Administrative First Instance Court ruled in favour of British American Tobacco because the plain packaging measure had been enacted by an executive decree instead of a law adopted by Parliament. The Uruguayan government appealed this decision and on 11 October 2018 the Court of Appeal ruled in the government’s favour, although a law would still be necessary to establish plain packaging. Human rights lawyers are preparing to bring a landmark case against British American Tobacco on behalf of hundreds of more than 350 children and their families forced by poverty wages to work in conditions of child labor in the fields of Malawi. Leigh Day’s lawyers anticipate the number of child laborer claimants to rise as high as 15,000. |Following the implementation of legislation enabling provincial governments to recover healthcare costs directly from tobacco manufacturers, ten actions for recovery of healthcare costs arising from the treatment of smoking and health-related diseases have been brought. These proceedings name various Group companies as defendants, including the Company, Investments, Industries, Carreras Rothmans Limited (collectively, the “UK Companies”) and Imperial Tobacco Canada Limited (“Imperial”), the Group’s operating company in Canada, as well as RJRT and its affiliate R.J.Reynolds Tobacco International Inc. (“RJRTI”) (collectively, the “RJR Companies”). Pursuant to the terms of the 1999 sale of RJRT’s international tobacco business to Japan Tobacco Incorporated (“JTI”), JTI has agreed to indemnify RJRT for all liabilities and obligations (including litigation costs) arising in respect of the Canadian recoupment actions. Subject to a reservation of rights, JTI has assumed the defence of the RJR Companies in these actions. The ten cases are proceeding in British Columbia, New Brunswick, Newfoundland and Labrador, Ontario, Quebec, Manitoba, Alberta, Saskatchewan, Nova Scotia and Prince Edward Island. The enabling legislation is in force in all ten provinces. In addition, legislation has received Royal Assent in two of the three territories in Canada, but has yet to be proclaimed into force.

A report of a meeting between Director General of the EU's Taxation and Customs Union and British American Tobacco showed how BAT used the findings of a study it commissioned (undertaken by Deloitte/Taj consultants) to support their views against increasing minimum rates in the Tobacco Excise Directive. The study concluded that an increase in rates would unduly affect Eastern European countries, increase illicit trade and vastly increase price elasticity of cigarettes. Furthermore, they argued that the Directive should not be reviewed claiming that there is “no sufficient data” to impose tax regimes on e-cigarettes or heated cigarettes. Similarly, in February 2019, BAT provided the Taxation and Customs Union  with its “Analysis of the potential impacts of revising the minimum excise requirements in the European Excise".
