British American Tobacco is one of the leading, multi-category consumer goods companies. It employs over 55,000 people, with market leadership in over 55 countries and factories in 42. Its strategic portfolio is made up of its global cigarette brands and an increasing range of potentially reduced-risk products, comprising vapour and tobacco heating products, as well as oral tobacco and nicotine products such as moist snuff and snus. Company Overview

British American Tobacco is the largest international tobacco company by revenue. [2] British American Tobacco is a publicly traded company based in London. In 2018, British American Tobacco operated in over 200 markets with 29 markets selling its heating, vapour, and modern oral products. [3] British American Tobacco is the third largest producer in the global tobacco market, and controls 11.4 percent of the international cigarette market. Top selling brands include Pall Mall, Rothmans, Kent, Dunhill, and Lucky Strike, and these five brands account for more than half of all British American Tobacco cigarette sales.[4] British American Tobacco has a strong presence in Lausanne, Switzerland and at cigarette factory at Boncourt, canton Jura. [5] In 2019, British American Tobacco reported a revenue increase by 5.7 percent to GBP 25,877 million. [6]:2 The company plans to cut 2,300 jobs globally as part of a new "focus on simplification and removal of management layers". [7] At the May 2020 AGM, shareholders signaled their discontent at the annual meeting by narrowly voting against an advisory vote on compensation for the company’s executives. A preliminary result of the votes indicated that about 51% of shareholders voted against the advisory, while 49 percent voted for it. [8]

In April 2021, more than 38 percent of BAT shareholders opposed the directors’ remuneration report after CEO Jack Bowles received a 3 per cent increase in his salary to GBP 1.3 million, following a 9.5 per cent rise the year before. [9]

Management Board

Outgoing British American Tobacco independent chairman Richard Burrows stepped down from his role after more than nine years. [10] He is succeeded by Luc Jobin. Luca Gentile is the new Head of External Relations and Communication of British American Tobacco Italy. [11] In July 2019, British American Tobacco Korea has named Kim Eui-soung as its new CEO. Jack Bowles Chief Executive Jack became British American Tobacco’s Chief Operating Officer for the International Business in October 2017. Joining the Group in 2004, Jack was Chairman of British American Tobacco France in 2005 before taking up the role of Managing Director of British American Tobacco Malaysia in 2007. He joined the Management Board as Regional Director for Western Europe in October 2009 before becoming Regional Director for the Americas in October 2011. He was appointed Regional Director, Asia-Pacific in January 2013, a position he continued to hold until 1 January 2018 when a new regional structure came into effect.[13]
Jerome Abelman Director, Legal and External Affairs And General Counsel Jerry was appointed Director, Legal and External Affairs and General Counsel in May 2015, having joined the Management Board as Group Corporate and Regulatory Affairs Director in January 2015. He has been with the Group for over 15 years and has held a number of roles in Legal. Jerry was Regional General Counsel, Asia-Pacific from 2010 to 2014, before becoming Assistant General Counsel – Corporate and Commercial. Jerry was a member of the Board of Reynolds American Inc. (RAI) from February 2016 until the acquisition of RAI in July 2017.[13]
Marina Bellini Director, Digital and Information Marina was appointed to a new role on the Management Board – Director, Digital and Information – in January 2019. This role is responsible for driving digital transformation across the Group and further enhancing the Group’s digital consumer experience capabilities. Marina joined British American Tobacco as Chief Information Officer (CIO) in 2018 having previously served as Global CIO and Global Business Services SVP at Anheuser-Busch InBev, where she was responsible for information technology transformation, including consumer digital marketing. Luciano Comin Regional Director, Americas and Sub-Saharan Africa Luciano Comin was appointed Regional Director, Americas and Sub-Saharan Africa in January 2019. He joined British American Tobacco as a Management Trainee in Argentina in 1992 and during his career with the Group has gained broad experience in a wide range of roles, including Marketing Director in Venezuela, Marketing Director in Mexico and General Manager of BAT Mexico. Luciano was also Regional Marketing Manager for Western Europe and then Regional Head of Marketing, Americas and Sub-Saharan Africa before his appointment to the Management Board. [13]
Michael Dijanosic Regional Director, Asia-Pacific and Middle East Michael joined the BAT Management Board on 1 September 2020 in the role of Regional Director, Asia-Pacific and Middle East. He was previously Area Director for Asia-Pacific and Global Travel Retail.[13]
Zafar Aslam Khan Director, Operations Zafar Khan became a member of the Management Board as Director, Operations, on 1 February 2021, having previously been Group Head of New Categories Operations. [13]
Hae In Kim Director, Talent and Culture Designate Hae In was appointed Director, Talent and Culture Designate in January 2019 and will succeed Giovanni Giordano, currently Director, Group Human Resources, on 1 April 2019. She was previously Group Head of Talent and Organisational Effectiveness and has held several other senior HR roles in British American Tobacco, including Regional HR Director, Asia-Pacific and HR Director, Japan and North Asia. Prior to joining the Group, Hae In gained experience at Samsung, IBM Consulting Services and PwC. Hae In has been a Non-Executive Director of Pakistan Tobacco Company Limited since April 2015. [13]
Paul Lageweg Director, New Categories Paul was appointed Director, New Categories, a new role on the Management Board, in January 2019. This role, reporting directly to the Chief Marketing Officer, has end-to-end accountability for driving growth, innovation, world-class brand building and consumer insights for the Group’s potentially reduced-risk products. Paul has been with the Group for 13 years in various senior roles, including Regional Marketing Manager, Asia-Pacific and Middle East; Area Director, East Asia; and Global Head of Marketing Futures. Before joining BAT, Paul held senior marketing roles at Unilever and Kimberly-Clark.[13]
Tadeu Marroco Finance Director Tadeu was appointed Regional Director, Europe and North Africa in January 2018. He joined the Management Board as Director, Business Development, in September 2014 and was appointed Regional Director, Western Europe in December 2016, a position he held until 1 January 2018 when a new regional structure came into effect and Tadeu took up his current role. He joined British American Tobacco in Brazil over 20 years ago and his other previous roles include Regional Finance Controller, EEMEA, and Group Finance Controller. [13]
Dr. David O’Reilly Director, Research and Science David was appointed Group Scientific Director in January 2012. He has been with British American Tobacco for over 20 years and has held various positions in Group Research and Development. He has led the Group’s R&D efforts to develop reduced toxicant products and has also been Head of International Public Health and Scientific Affairs, responsible for engagement with the scientific, medical and public health communities.[13]
Guy Meldrum President and CEO, Reynolds American Inc. Guy Meldrum was appointed President and CEO of Reynolds American in September 2020. He was previously the company's the Regional Director, Asia-Pacific and Middle East 2019. He joined the company in 1992 and has held several senior roles in the Group including Area Director, North Asia Area and Marketing Director, Russia.[13]
Johan Vandermeulen Regional Director, Asia-Pacific and Middle East Johan was appointed Regional Director, Asia-Pacific and Middle East in January 2018. He joined the Management Board as Regional Director for Eastern Europe, Middle East and Africa in September 2014, a position he held until 1 January 2018 when a new regional structure came into effect and Johan took up his current role. Kingsley Wheaton Chief Marketing Officer Kingsley was appointed Regional Director, Americas and Sub-Saharan Africa in January 2018. He joined the Group in 1996 and has held a number of roles in Marketing. He was Marketing Director in Nigeria and Russia, before becoming General Manager in Russia. He was Global Brand Director responsible for the Kent and Vogue brands, before joining the Management Board in January 2012 as Deputy Corporate and Regulatory Affairs Director. Forecast

British American Tobacco said the sales impact from COVID-19 would be around 2.5 percent, lower than the 3 percent it had expected earlier. [16] British American Tobacco said it was maintaining its guidance of high single figure earnings per share growth for 2020 while expecting some impact on volume and revenue growth in the second-quarter due to the coronavirus. [17] British American Tobacco closed its agricultural tobacco production operation in the country. One of the reasons for this decision is the decrease in the demand for tobacco in the country. [18] In July 2020, the reported revenue increased 0.8 percent to GBP12,271 million (30 June 2019: £12,170 million). [19]

COVID-19 Response

British American Tobacco subsidiary Kentucky BioProcessing is using “proprietary, fast-growing tobacco plant technology” in pre-clinical testing on animals, being one of dozens of companies and public sector organisations worldwide racing to develop a COVID-19 vaccine. [20]

Using references to “stay at home” orders, British American Tobacco pushed online sales of its e-cigarette Vype with special discounts in several countries. [21]

Czech Republic

According to a study by British American Tobacco, the border closure between the Czech Republic, Germany and Austria abolished the border tobacco trade. The 500 tobacco shops in the border area had to close. According to the company, cross-border trade accounts for up to 30 percent of the domestic market, which equates to a loss of CZK 1.8 billion per month for the state's budget. [22]

Mexico

British American Tobacco in Mexico announced the suspension of its activities in Mexico due to the spread of the Covid-19. [23]

Ministry of Business, Innovation, and Employment confirmed that Imperial Tobacco in Petone, Lower Hutt could stay operational because the "ongoing supply of consumer goods needs to continue". [24]

Kazakhstan

In Kazakhstan, BAT provided Glo-branded masks to more than a dozen Instagram influencers who posted photos wearing the masks, with captions advertising free Glo masks with the purchase of a Glo device. [25]

Russia

The production in three of Russia's largest tobacco companies, including Philip Morris Izhora, Petro LLC (owned by Japan Tobacco International) and British American Tobacco was stopped due to COVID-19. [26]

Serbia

British American Tobacco donated one million dinars to the Red Cross in Vranje. [27]

South Africa

British American Tobacco South Africa is pursuing legal action against the South Afican government over their ban on cigarette sales during the national lockdown. President Cyril Ramaphosa said in a media briefing that the ban on cigarettes will continue under alert Level 3 while alcohol sales will be allowed. Batsa’s announcement comes after the company withdrew their decision to go ahead with legal proceedings previously. [28] In June 2020, British American Tobacco started accepting "holding orders" from its customers, not actually selling cigarettes. According to a company's spokesperson: "No deliveries will be made until the sale of tobacco products is allowed. The date for delivery will depend on when the ban is lifted." [29]

BAT South Africa has been accused of producing research reports to divert attention from an ongoing investigation into the company’s alleged participation in organised crime and cigarette smuggling in West Africa. A report by Ipsos and another by the Organised Crime and Corruption Reporting Project (OCCRP) show evidence of TI’s involvement in the region, in particular BAT SA. [30] In February, the Fair Trade Independent Tobacco Association said that it was not surprised by the revelations into allegations of smuggling against BAT. BAT SA has denied these allegations. [31]

Spain

British American Tobacco launched glo, its heated tobacco product, in Spain where reported deaths from the COVID-19 virus are the 3rd highest in the world. [32]

Acquisitions

British American Tobacco unveiled "Btomorrow Ventures", its corporate venture arm in July 2021. Btomorrow Ventures enables British American Tobacco to "invest in its future by gaining early access to cutting-edge technology, unlocking innovation through R&D collaborations and enabling test and learn” in new product categories." [40] In 2020, British American Tobacco took over shops from the medium-sized e-cigarette retailer Hello Vape. [41]

In 2018, the Group acquired Quantus Beteiligungs-und Beratungsgesellschaft mbH, which houses the vapour retail business of High End Smoke in Germany. [3]:254 On October 21, 2016, then British American Tobacco CEO Nicandro Durante, publicly announced an offer for the 57.8 percent of Reynolds American, Inc. that British American Tobacco did not already own. According to media reports, Reynolds American, Inc. rejected British American Tobacco’s initial buyout offer of USD 47 billion as being too low. In January 2017, Reynolds American, Inc. accepted increased offer of USD 49 billion with the deal finalised in June of 2017.[42]

Investments

In August 2019, British American Tobacco established “consumer healthcare” and “consumer focused” companies under the names of Nicoventures and Nicovations. [44]

The government of Bangladesh holds 9.49 percent share in British American Tobacco Bangladesh. [45]

Reinet Investments, which owns about 3 percent of British American Tobacco, says an increase in the value of its stake in UK insurer Pension Corporation has partially made up for the company's share decline. [46]

At 31 December 2015, the following substantial interests (3 percent or more) in the Company’s ordinary share capital (voting securities) had been notified to the Company in accordance with Section 5.1.2 of the Disclosure Rules and Transparency Rules. As at 24 February 2016, the Company had not received notification either of any change in the interests below or that any other person holds 3 percent or more of its ordinary shares. [38]:114

In 2015, the organization completed it's acquisition of TDR in Croatia, the leading independent cigarette manufacturer in Central Europe. British American Tobacco also acquired the rest of the shares in its Brazilian subsidiary, Souza Cruz, not currently owned by the Group and de-listed the company the same year. [38]:14

In 2015, British American Tobacco signed a vapour products technology-sharing agreement with R.J. Reynolds Tobacco Company. The agreement provides a framework for collaboration and mutual cross-licensing of the parties’ vapour product technologies up to 31 December 2022. British American Tobacco completed the acquisition of the CHIC Group, the market-leading Vapour Product (e-cigarette) business in Poland. [38]:5

In August 2018, The Guardian reported more than GBP 1.7 billion had been directly invested in tobacco company stocks by healthcare providers, fire authorities and schools via UK council pension funds. It found Council retirement schemes in the UK are major investors in firms including British American Tobacco, Imperial Brands and Philip Morris International, according to data compiled from more than 100 freedom of information requests. [47]

Tobacco companies have received more than GBP 45 million investment from the United Kingdom's Lincolnshire County Council’s pension fund. The current investment (as of January 2019) for British American Tobacco sits at GBP 24.1 million – one per cent of the total fund. [48]

The Auckland Council has been told it might have more than $700,000 indirectly invested in British American Tobacco. The council has been told by the Janus Global Research growth fund that it might have more than $700,000 invested in the company. [49]

Government Ownership of British American Tobacco

In Bangladesh, the government owned Investment Corporation of Bangladesh; Shadharan Bima Corporation; Bangladesh Development Bank Limited; Government of People's Republic of Bangladesh are owned by British American Tobacco (72.91 percent). [50]

Market Share

The Group’s cigarette market share in its Key Markets continued to grow strongly (up 40 bps) in 2017. This was due to the comapny's GDBs, which grew 110 bps (ex US) and currently accounts for more than 50 percent of Group cigarette and THP volume outside the US. Over the year, market share in the US was up 20 bps, with the RAI Strategic Brands growing 40 bps. Total Group cigarette and THP volume grew 3.2 percent to 686 billion, or on an organic basis fell 2.6 percent, outperforming the industry, which was estimated to have declined by around 3.5 percent. Flagship THP, glo, first launched in Japan in December 2016, reached 3.6 percent market share by the end of 2017 – having been rolled out nationally from October 2017. Since then, 50 percent of the overall category growth in Japan has been from glo – with initial progress in other launch markets such as South Korea, Russia, Canada, Romania and Switzerland. [35]:13

Emerging Markets

British American Tobacco has a significant presence in emerging markets across South America, Africa, the Middle East and Asia. According to the company's website emerging markets will account for 60 percent of volume in the enlarged group. Over the last 5 years, revenue per pack in emerging markets has grown at more than twice the rate compared to developed markets. With generally low cigarette pack prices and expectations of continued growth in consumer disposable income over the long term, the future profit growth opportunity remains strong. [51] Nik Oliver, consumer goods analyst at UBS said in a March 2017 interview with Financial Times, British American Tobacco derives more than 50 per cent of its total revenues from emerging markets with the strongest emerging market portfolio of the company's peers. [52]

Factory Openings and Closures

A cigarette factory with the capacity to produce three billion Dunhill cigarettes per year is expected to open up in Mali this year, a partnership between British American Tobacco and the Malian government. [53]

British American Tobacco closed offices in Georgia. Two years ago British American Tobacco won a USD 00 Million Dispute with the Georgian government. The company asserts that paragraph 2 of article 5 of Georgian Law on Tobacco Control is unconstitutional as it bans sales of tobacco products under cost in Georgia. [54]

It was reported British American Tobacco will invest HRK200 million (USD 32.07 million) to produce heated cigarettes at its factory in Kanfanar, Croatia.[55]

Last year British American Tobacco Hellas said it would create 200 new job positions in Greece. The company didn't stipulate what type of jobs will be available. [56]

British American Tobacco is looking to expand production of nicotine pouches at its factory in Pecs, Hungary. The move would make the Pecs tobacco factory the biggest producer of pouches in the BAT group. [57]

In 2020, British American Tobacco opened a new leaf processing facility in Fiji. [58]

British American Tobacco announced in late 2019 that it planned to lay off 30 percent of its staff in Nicaragua. [59]

In November 2019, Zambian finance Minister Bwalya Ng’andu officially opened the USD 2 million British American Tobacco Zambia Cigarette Manufacturing Plant in the Lusaka South Multi-Facility Economic Zone. [60]

British American Tobacco announced plans to set up a plant to manufacture oral nicotine pouches with zero tobacco in Kenya. [61]

In October 2019 British American Tobacco’s factory in Ukraine’s Chernihiv Oblast stood idle after the company halted production "indefinitely". The company alleged that new tax legislation would make continued operations in Ukraine impossible. But anti-smoking activists believed that BAT is simply trying to pressure the Ukrainian president to veto an amendment to the pricing regulation law. [62] Shortly after the announcement, British American Tobacco met with then Prime Minister Oleksiy Honcharuk and announced it would resume production after the cancellation of the amendment to law 1049 on pricing regulation. [63]

In 2018, British American Tobacco had 55 factories, 47 of which produced cigarettes, [3]:19 including two new factories, one in Zambia(Lusaka) and one in Malaysia. [3]:23 In 2018, British American Tobacco invested EUR 45 million in a plant in Croatia. According to the company's director for the Adria region, Antal Bekefi, the company has been investing significant funds into research and development since 2012, investing more than USD 2.5 million for new generation products. [64] British American Tobacco is considering opening another factory in Malaysia. [65]

British America Tobacco Zambia Plc constructed a cigarette manufacturing plant in 2018 at a cost of USD 25 million aimed at localizing its brand portfolio in Zambia. [66]

In June 2018, British American Tobacco announced it would invest €800 million over the next five years in its factory in Ploiești, Romania. The investment, representing the generation of 200 new jobs in Romania, aimed to support the expansion of its glo product in countries across Europe during the second half of 2018. [67] The unit in Ploiesti is the third in the world (after South Korea and Russia) to produce Neosticks for glo and the first in Europe. [68] The company completed the construction June 2020. [69]

Combustible Tobacco Products

British American Tobacco's share of the cigarette market has been largely driven by five global brands – Dunhill, Kent, Lucky Strike, Pall Mall and Rothmans.[70] At the end of 2018, British American Tobacco had 47 manufacturing facilities producing cigarettes around the world. [72]

Vapour Products

In December 2020, British American Tobacco launched VapeExplained.com, a website providing smokers and vapers with selected answers to the questions allegedly most commonly searched for online on this topic. [73]

British American Tobacco said it would "welcome" the U.S. health regulator’s move to ban popular e-cigarette flavors in the country, saying it would comply with the new guidelines aimed at curbing teenage vaping. Under a new policy that will go into effect in February, e-cigarette makers will be banned from selling pod-based e-cigarette flavors, including fruit and mint, in the United States, leaving only menthol and tobacco flavors on the market.' [74]

British American Tobacco is looking at introducing CBD (cannabidiol) and cannabis flavourings in their products. [75]

According to the 2018 Harm Reduction report, British American Tobacco sells its vapour products in 13 countries: Bahrain, Canada, Colombia, France, Germany, Greece, Guatemala, Italy, Ireland, Kuwait, New Zealand, Poland, United Kingdon, and the United States. [76]

E-cigarettes

British American Tobacco launched Vuse ePod 2 device in Spain in June 2021.[77]

In March 2021, British American Tobacco South Africa opened the first Vuse Inspiration Store in South Africa. [78]

In July 2019, British American Tobacco received approval from the South African Competition Commission for the acquisition of Twisp, a leading South African vaping products company. [79]

Reynolds American Inc., the U.S. business unit of British American Tobacco PLC, submitted an application for some of its Vuse e-cigarettes to the Food and Drug Administration in 2019. The submission covered a group of products in its Vuse Solo line of e-cigarettes, including several different flavors. The Solo refill pods come in flavors such as melon, chai, mint and berry.[80] Later that year Reynolds announced that the U.S. Premarket Tobacco Product Application (PMTA) for VUSE vapour products had been filed by the Food and Drug Administration for substantive scientific review, moving the application one step further through the review process. [81]

British American Tobacco confirmed that it will introduce Vuse in Malaysia once the regulatory framework for the product category is finalised. [82]

Oral Products

In November 2020, US business of the BAT Group acquired the nicotine pouch Dryft. This acquisition expanded the company's Modern Oral portfolio in the US, expanding from 4 to 28 product variants. [83]

Oral products are available in five countries: Finland, Norway, Sweden, Switzerland, and the United States. [76]:9

Russian airline passengers will be able to receive a LYFT nicotine delivery product from British American Tobacco on a dozen flights. [84] Czech transport Company Leo Express allows for the sale of LYFT nicotine bags on board of its fleet. [85] LYFT was promoted to smokers in Czech republic during the COVID-19 quarantine as an "alternative" to smoking. [86]

The U.S. Food & Drug Administration announced that, for the first time, it has authorized the marketing of products through the modified risk tobacco product pathway. The authorizations are for eight Swedish Match USA, Inc. snus smokeless tobacco products sold under the “General” brand name. The action further authorized the manufacturer to market these specific products with the claim “Using General Snus instead of cigarettes puts you at a lower risk of mouth cancer, heart disease, lung cancer, stroke, emphysema, and chronic bronchitis.”[87]

Heated Cigarettes

Specifically, this new device comes a year and a half after the company landed in this category in Spain with the ePen 3, within its strategy for 'Building a Better Tomorrow' ('A Better Tomorrow'), which aims to reduce the impact of your business on the health of smokers."

British American Tobacco has pilot-launched its first CBD vaping product, VUSE CBD Zone. [88]

In 2021, British American Tobacco has become the first company to officially launch tobacco heating technology on the Uzbek market. [89]

In 2019, British American Tobacco created three global brands for its “New Category product” portfolio: VUSE for vapour products; VELO for modern oral products and glo for tobacco heating products to further accelerate the growth of their New Category business. [90] By the end of 2019, VELO will be available in 100,000 stores in the United States. [91] According to Štěpán Michlíček, Marketing Director of British American Tobacco for Central and Eastern Europe, 60,000 people already use heated glo products in the Czech Republic. [92]

Heated Tobacco Products by British American Tobacco are available in 16 countries: Bulgaria, Canada, Croatia, Czechia, Japan, Kazakhstan, Greece, Russia, Poland, Romania, Serbia, South Korea, Switzerland, Ukraine and the United States. [76]:6 The company is awaiting approval to sell its heat-not-burn products in Malaysia. [93]

The 2018 heated tobacco product revenue increased to GBP 565 million or GBP576 million, at constant rates. The glo brand has achieved 4.7 percent market share in Japan, and continues to grow market share in South Korea, Romania and Italy. [3]:12 British American Tobacco Korea unveiled glo pro in November 2019. [94]

British American Tobacco launched glo in 2015. Japan is also the market where heat-not-burn has had the biggest success, and the amount of cigarettes sold there has dropped by about 20 percent over two years. South Korea is currently the market with the next-biggest potential. [95]

Rolling Stone magazine organised a 20-minute rooftop concert series that critics suggested made e-cigarettes look cool to kids. The series was geared toward an audience that could include people under the legal smoking age of 21. The bands included Cold War Kids, singer Elle King and rapper Oddisee. Saturday Night Live cast member Chloe Fineman hosted the event. [96]

In April 2018, Rolling Stone Magazine profiled several British American Tobacco sponsored events around Italy that have been used to promote glo by continuing to build an association with fashion, music, technology, and partying. [97] In September 2018, British American Tobacco launched glo in Ukraine. [98] British American Tobacco launched new liquid-type e-cigarette Glo Sens in South Korea. [99] The company says it will launch two new tobacco heating products in Japan under its glo brand. [100] The new products, glo pro and glo nano, feature new heating technologies, slimmer sizes and will be available in Japan from October 2019. [101] As of November 2019, 60,000 people use heated glo products in the Czech Republic. [102]

In a press release from December 2018, British American Tobacco announced it is introducing a new vaping device in the United Kingdom market, called Vype iSwitch. The iSwitch comes in a standard version, which retails for about GBP 30 (USD 38), and an upscale version, the Maxx, which sells for about GBP 50. [103] In December 2018, Vype ePen 3 launched in New Zealand. [104] In 2020, British American Tobacco is getting ready to introduce the product in the Czech Republic. [105] In September 2018, The U.S. Food and Drug Administration determined that British American Tobacco had not produced adequate data to show its Camel smokeless tobacco pouches were a less risky alternative to cigarettes. [106] In February 2019, British American Tobacco launched Vype iSwitch and Vype iSwitch Maxx with ‘Puretech’ technology that incorporates an ultra-slim stainless steel blade that heats the e-liquid to create vapour. [107] In 2019, British American Tobacco New Zealand launched Vype in New Zealand. [108] British American Tobacco is set to introduce nicotine snus pouches in Kenya. [109] The Vype ePod won best e-cigarette at the 2020 Product of the Year Awards in the United Kingdom, for the second consecutive year. [110]

To date, British American Tobacco published 25 peer-reviewed articles on heated tobacco products. In 2018, the company presented at 24 scientific conferences and external meetings. [3]:28 The company carried out a series of tests tests to prove that its vaping products produce ‘greatly reduced mutagenicity, cytotoxicity and effects on wound healing as compared to cigarette smoke.’ [111]

Nicoventures

In April 2011, British American Tobacco established a start-up company, Nicoventures Limited. The company's focus is on the "development and commercialisation of innovative regulatory approved nicotine products." [112] Kingsley Wheaton, the former Group Corporate & Regulatory Affairs Director, was appointed Managing Director - Next Generation Products in January 2015. Volumes

In 2019, British American Tobacco reported that its total cigarette and THP volume declined 4.4 percent to 677 billion sticks, with cigarette volumes down 4.7 percent and THP volumes up 31.6 percent. In 2018, the volume was 3.5 percent lower as growth in Pakistan, Japan (driven by THP), Turkey, Poland, Romania and Egypt was more than offset by declines in the GCC, US, Russia and Brazil.[3]:20 In 2018, volume was up 0.7 percent in the Asia-Pacific and Middle East region at 228 billion sticks driven combustibles volume in Pakistan and the performance of glo in Japan and South Korea with sales of 6.5 billion sticks in the period. [3]:347

Philip Morris International and British American Tobacco have been caught drastically underreporting their production and even using their facilities to roll out black-market cigarettes. In a 2017 raid, Pakistani authorities found 1.3 million black-market cigarettes with the branding of a Philip Morris subsidiary in a van leaving one of the company’s former factories—which the tobacco giant was apparently using as an undeclared warehouse. That same year, Philip Morris International had reported a decrease in production, claiming competition from illicit manufacturers. This under-reporting has added up to a tax shortfall of as much as 47 billion rupees between 2015 and 2018. [113]

Volume of Cigarettes by Region

Effective January 2018, British American Tobacco uses a new organizational structure consisting of four regions: Americas and Sub Saharan Africa (including East & Central Africa; West Africa and South Africa), Europe and North Africa (including Russia, Ukraine, Caucasus, Central Asia, Belarus, and Turkey), Asia-Pacific and Middle East and the United States of America.[114]

Social Media

In 2021, British American Tobacco and Philip Morris International invested GBP £1 billion in promoting its products on TikTok. [117]

The Bureau revealed that British American Tobacco employed aggressive marketing tactics in different countries around the world to attract a new generation of users including non-smokers to highly addictive nicotine and tobacco products. These described in the article include:

  • Presenting nicotine products as cool and aspirational in a glossy youth-focused advertising campaign;
  • Paying social media influencers to promote e-cigarettes, nicotine pouches and tobacco on Instagram, notwithstanding the platform’s ban on the practice;
  • Sponsoring music and sporting events, including an F1 e-sports tournament that was streamed live on YouTube and could be watched by children;
  • And an international free samples offer for nicotine pouches and e-cigarettes that appears to have attracted underage people and non-smokers. [118]

An analysis of social media and influencer posts found evidence of tobacco companies using #StayAtHome hashtags, creative and giveaways – including branded masks – to market e-cigarettes, vapes and heated tobacco products. [119]

It found that on social media, the two largest tobacco companies – Philip Morris International and British American Tobacco – had appropriated 'Stay at home' hashtags used by governments and health authorities to market heated cigarette products, such as Glo and iQOS, and e-cigarettes, including Vype."

British American Tobacco has been nominated for a number of PR and communications industry awards across Southeast Asia, South Asia and ANZ regions. The nominations are for the comppany's Sampai Bila campaign in Malaysia. The company was nominated in these categories: Best Corporate Affairs Strategy, Best Crisis / Reputation Management Strategy, Best Event-Led PR Campaign, Best Insights-Driven PR, and Best PR-led Integrated Communications. [120] The company received a Silver trophy for the Best Corporate Affairs Strategy at the PR Awards 2020 for the campaign. [121]

At the end of 2019, the United Kingdom's Advertising Standards Authority ruled that British American Tobacco must stop using any public Instagram account to promote e-cigarettes in the country, which would include the use of influencer marketing to advertise e-cigarettes. The agency also ordered British American Tobacco to remove all Instagram advertisements for Vype that were under investigation.[122]

British American Tobacco’s latest music YouTube commercial has prompted Korean health authorities to discuss new legislature to restrict advertisements of e-cigarette devices. The ad “Glo Sens X Loopy&nafla” features popular musicians. Korean health authorities strictly restrict direct advertisements of tobacco products. However, Glo Sens is not classified as tobacco but as an electronic device used to heat e-cigarette products. [123] German actress Bonnie Strange wrote in an Instagram post "Feeling Vype af” that features her posing at a festival with a wisp of smoke trailing from her lips. The post promoted British American Tobacco’s vaping product Vype. [124]

In February 2019, Campaign For Tobacco Free Kids and Netnografica LLC published the results of a two-year investigation into how the big tobacco companies, including Philip Morris, British American Tobacco, Japan Tobacco, and Imperial Brands used social media influencers to promote their products online. [125]

The Tobacco Institute of Southern Africa paid social media celebrities in what could be a ploy to undermine new government efforts to curb tobacco use in the country. The social media campaign coincided with the July 2018 release of proposed anti-tobacco legislation that would curtail advertising and smoking in public places, with violators facing fines and even up to three months in jail. [126]

Sponsorship

British American Tobacco sponsored concerts of Spanish boyband Dvicio. The exclusive event in Madrid also served as a promotional opportunity for the company's new heated cigarette, Glo. [127] In April 2021, the company worked in collaboration with several artists during its Vuse Design Challenge experience, creating two art installations at the Tampa Convention Center, Florida and the painting of an Arrow McLaren INDY Car trackside in Nashville, Tennessee. [128]

Vuse and Arrow McLaren SP continue to work together - multi-year INDYCAR agreement and partnership expansion that includes enhanced activation and assets, and a new Vuse-titled livery on the No. 7 Vuse Arrow McLaren SP Chevrolet. The Vuse brand integration is part of a broader enhanced partnership deal between BAT, R.J. Reynolds Vapor Company’s (RJRVC) ultimate parent group, and McLaren Racing, as a continuation of the global partnership with the McLaren Formula 1 team, of which BAT is a Principal Partner. [129]

RJRVC is sponsoring the U.S. leg of the band’s upcoming concert tour in conjunction with its London-based parent, British American Tobacco. The Fratellis will offer exclusive access to their new song “Strangers in the Street” via Vuse Vapor’s U.S. age-restricted Instagram channel.[130]

British American Tobacco continues to support a number of CSR initiatives in Bangladesh, including an afforestation program [131].

British American Tobacco is also one of Associate supporters of the British Royal Academy of Art. [132]

In 2019, British American Tobacco announced a multi-year sponsorship deal with McLaren Racing. The partnership focuses around the promotion of British American Tobacco's “reduced risk products”. [133] The Centre for Substance Use Research has taken money from Philip Morris International and British American Tobacco. [134] Tobacco company branding and logos will be banned entirely from the Melbourne Grand Prix to close a loophole that was exploited by cigarette giant Philip Morris and Ferrari. [135] The Australian state government has issued a ban on advertisements for vaping at the Australian Motorcycle Grand Prix at Phillip Island. [136] British American Tobacco is expanding their sponsorship of the McLaren Formula One team in 2020 to boost marketing of heated tobacco products. McLaren will provide more promotional spots on their cars next year and British American Tobacco will also be a partner for the team as it returns to full-time IndyCar competitions in the United States. [137] The new McLaren Racing car for the 2020 Formula 1 season has revealed the next iteration of “dynamic branding” associated with the team’s extended and expanded deal with new principal partner British American Tobacco. The launch of the papaya and blue MCL35 car at the team’s headquarters in Woking, England revealed the tobacco brand’s ‘A Better Tomorrow’ tagline. During the season, BAT will also display its Vuse vaping brand and, for the first time, its Velo oral-nicotine products at races in some jurisdictions. [138] In 2019, British American Tobacco sponsored the Bora’s Theatre Days in Serbia. [139] British American Tobacco in partnership with McLaren created VELO ESERIES where celebrities go head-to-head against influencers. [140]

The PETA International Science Consortium Ltd., Imperial Brands PLC, Altria Client Services, British American Tobacco PLC, and Philip Morris International Inc have joined together to donate USD 110,000 worth of equipment that will help to replace the use of animals in respiratory testing with more human-relevant, non-animal test methods. [141]

British American Tobacco Nigeria Foundation created the Farmers for the Future grant, aimed at giving young people the opportunity to access funds to establish viable agricultural enterprises. The scheme is an annual competition organised for final year students of Agriculture in Nigerian tertiary institutions and recent graduates. [142]

BAT Bangladesh deposited BDT 8.82 crore (about USD 1 million) to the Bangladesh Labour Welfare Foundation fund, under the Ministry of Labour and Employment. When BAT Bangladesh representatives handed over the check to the State Minister for Labour and Employment, the ministry promoted this news on its official Facebook page and acknowledged the company as its partner organization.[143]

Controversies

Tobacco workers in North Carolina have called for international solidarity over “union-busting” operations by the British American Tobacco. They have united in the Farm Labour Organising Committee in their campaign for the right to organise and bargain collectively to improve their working and living conditions. [144]

According to research by Suzan Burton & Becky Freeman from The University of Sydney, former employees from British American Tobacco Australia and Philip Morris Internationl described incentives programmes whereby top performing retailers were taken on all-expenses paid vacations. According to two former employees of British American Tobacco Australia, these high-end experiential incentives were given to tobacco retailers who had achieved significant sales percentage ‘uplift’ during a promotional period. One participant provided the example that British American Tobacco Australia would run a promotion over a specified period of time whereby the tobacco retailers with the highest percentage uplift in Winfield sales (one of the major Australian tobacco brands) would go into a draw to receive an overseas all-expenses paid vacation. Tobacco companies would receive the sales data to measure performance through product scanning technology at point-of-sale, however, it was noted that data could not be easily obtained from ‘mom and pop’ type stores, making it difficult to include these stores in these incentive programmes. Yet despite such challenges, these retail outlets were described as being a ‘big target’ for tobacco companies as they were the easiest retailer type to influence. [145]

British American Tobacco in France launched "Vaping Days". For three days, a hundred BAT employees provided a field presence to "raise awareness" among smokers about vaping as an "alternative to tobacco". [146]

Dutch tax authorities demand EUR 1 billion euros from British American Tobacco. The company allegedly avoided taxation in the Netherlands between 2003 and 2016. [147]

British American Tobacco hired young models to sell its products despite having an explicit policy banning under-25s from appearing in adverts. The company paid social media influencers to star in a promotional campaign for glo, a heated tobacco device, in violation of its own marketing rules that state: “No person appearing in our advertising will be under 25." [148]

Based on an investigation by the Tax Justice Network, British American Tobacco has been accused of shifting profits from developing countries to a UK subsidiary. The company allegedly would avoid paying USD 700 million between now and 2030 in Bangladesh, Indonesia, Kenya, Guyana, Brazil, and Trinidad and Tobago. [149]

Two new studies from the Tobacco Control Research Group, published in the BMJ journal, Tobacco Control, expose evidence that big tobacco companies are still facilitating tobacco smuggling, while attempting to control a global system designed to prevent it and funding studies that routinely overestimate levels of tobacco smuggling. [150]

Financial disclosures for President Trump's interim choice for U.S. Defence Secretary role Patrick Shanahan showed he was invested in more than 400 diverse stocks for companies such as British American Tobacco, CBS, Diamond Offshore Drilling, Facebook, Marathon Petroleum and Qualcomm. [151]

In August 2018, The Guardian reported that British American Tobacco has promoted sales of its cigarettes in some of the most fragile, war-torn and unstable countries of Africa and the Middle East. Documents acquired by The Guardian describe how cartons of cigarettes were distributed to traders hidden in black bags in Somalia after Al-Shabaab banned sales and threatened punishments under Sharia law between late 2008 and early 2009. The documents also show that British American Tobacco made plans to launch in South Sudan just two days before it gained independence from the north after years of destruction from a civil war that left 4 million people displaced. [152]

Internal British American Tobacco documents revealed that illicit trade was both profitable and integral to British American Tobacco operations in the People’s Republic of China over the span of two decades.[153] British American Tobacco's involvement in cigarette smuggling in Africa and Lebanon has also been documented. [154][155]

A 2015 BBC investigation uncovered evidence of bribery when British American Tobacco illegally paid politicians and civil servants in countries in East Africa. [156] Independent further reported British American Tobacco recruited and paid for a union to disrupt production at one of its chief rivals. [157] Emails reveal British American Tobacco made illegal payments to two members and one former member of the World Health Organization's Framework Convention on Tobacco Control. British American Tobacco lobbyist Julie Adell-Owino arranged bribes totalling USD 26,000 for three public officials in Rwanda, Burundi and the Comoros Islands. All three officials were connected to a United Nations effort to reduce the number of tobacco related deaths, the Framework Convention on Tobacco Control. [156] British-American Tobacco's response to the allegations stated: "The truth is that we do not and will not tolerate corruption, no matter where it takes place."

But the evidence, as presented, looks damning. [158] In 2016, lawyers investigating bribery and corruption allegations were urged to expand their investigation after fresh international accusations emerged. According to court documents seen by The Independent, two former police officers working for private corporate investigation companies paid cash to South African law enforcement officials to disrupt British American Tobacco’s competitors’ business operations. [159]

The South African Revenue Service says it is owed R 143 million by the local arm of British American Tobacco as a result of tax fraud and evasion. [160] In 2014, South African subsidiary British American Tobacco Zimbabwe (Batz) was under scrutiny from SARS who has unearthed errant and illegal behavior on the part of the company. [161]

Marketing to Kids

British American Tobacco is investigating an incident after a 17-year-old was offered a free sample of the company’s Vype brand. The minor was not told that the product contained nicotine and was not asked for proof of age. [162]

British American Tobacco organizes an annual global competition for students and graduates – with the chance to win an all-expenses-paid trip to London and an internship opportunity with the company. Participants are required to individually develop an original and innovative business idea. [163]

Voices for Interactive Choice & Empowerment, a rights organisation working on the development issues, accused British American Tobacco Bangladesh of targeting children though through sponsoring events like Battle of Minds. The Grand Finale of Battle of Minds 2020, a British American Tobacco recruitment initiative, was held on December 15 in Dhaka with the sponsorship from the company. [164]

British American Tobacco is under investigation by the UK Advertising Standards Authority over concerns the company promoted nicotine e-cigarettes and were likely to appeal to people under 18 years old. [165] Vype, a range of e-cigarettes owned by British American Tobacco, has been using fashion-style advertising to reach potential new customers, including glossy shoots with Lily Allen in which she matches different devices to her outfits. [166]

British American Tobacco signed up New Zealanders with large social media followings to promote its e-cigarette brand Vype by posting pictures of themselves vaping on Instagram. [167]

A Campaign for Tobacco-Free Kids investigation into over 100 social media campaigns by Philip Morris International, British American Tobacco, Japan Tobacco International and Imperial Brands revealed tobacco companies pay social media influencers on platforms like Instagram, Facebook and Twitter to advertise their products. [168] Campaign for Tobacco-Free Kids reported British American Tobacco is behind several high profile influencer marketing campaigns for its Lucky Strike and Dunhill cigarette brands. An influencer paid to promote British American Tobacco brands explained:

  “I put the pack of cigarettes here on the table and I take a photo. Because it’s obviously illegal. So they have this group of people in every city… They try to create this thing where they give packets of cigarettes to people with a certain number of followers, so that they post a picture with the packet. The final image they want to give is that smoking Lucky Strike is cool." [168]

According to the 2018 Annual report, the total amount of British American Tobacco’s political contributions made to non-EU political parties in 2018 was GBP 3,718,540 (2017: GBP4,832,321).[3]:70 RAI Companies reported political contributions totalling GBP 3,718,540 (USD 4,965,850) for the full year 2018 to US political organisations, non-federal-level political party committees and to campaign committees of various non-federal candidates. [3]:70

Research and Development

A study published by British American Tobacco in Drug and Chemical Toxicology analysed four variants of one of the company's MO nicotine pouch products Lyft+, three snus products, and two different NRT products in a lozenge and a gum format. According to the study, "the results showed that the MO products had a comparable toxicant profile to NRTs, which are currently considered to be the least risky of all nicotine products. The study also estimated that users of the studied MO products are likely to be exposed to far fewer and significantly lower levels of toxicants than those who use snus." [169]

British American Tobacco are investigating how people use vapor and tobacco heating products in Italy, comparing how consumers use heated tobacco product glo, and vapour product iSwitch, as well as another commercially available heated tobacco products and a reference cigarette. [170]

Portal Chemical & Engineering News reported that representatives from British American Tobacco, Japan Tobacco International, Philip Morris International, and Reynolds American attended the annual meeting of the American Society for Cellular & Computational Toxicology focused on non-animal toxicology testing. The website cited the ultimate goal to:

  "to convince officials at the U.S. Food & Drug Administration’s Center for Tobacco Products (CTP) that in vitro methods for predicting respiratory toxicology in humans are ready for prime time." [171]

A study by Oxford Economics, commissioned by British American Tobacco, revealed that Malaysia has the highest illegal cigarette incidence in the world and loses almost RM100 million every week to criminal smugglers and sellers. [172]

Corporate Social Responsibility

In 2020, Lemang Agricultural Services collaborated on a project with British American Tobacco to train and develop 150 new farmers at 15 sites in South Africa. [173]

For International Women's Day 2019, British American Tobacco created a toolkit around the #BalanceforBetter theme to "help" their offices around the world organise their own events and make "the celebrations as diverse and inclusive as they could possibly be."[174]

In 2019, British American Tobacco announced the roll-out of VerifY, a scheme aimed at ensuring that all retailers of e-cigarettes are aware of their role in the prevention of access to vaping by under-18s. [175] British American Tobacco Bangladesh was amongst 28 companies honored for practising transparency and good governance in their day-to-day operations by the Institute of Chartered Secretaries of Bangladesh, a professional body tasked with developing, promoting and regulating the profession of chartered secretaries, organised the awards. British American Tobacco Bangladesh won the gold award in the manufacturing category. [176]

In October 2018 Reuters reported that British American Tobacco ranked second and third (alongside Tesco) on the first Global Governance FTSE 100 League Table. The ranking judges companies based on their compliance with the 2015 Modern Slavery Act. [177]

In 2016, British American Tobacco Peru and British American Tobacco Central America and Caribbean were “recognised … amongst top employers in LatAm 2016”. British American Tobacco Mexico was recognised as the leading employer in the country and British American Tobacco West Africa won "awards for outstanding employee engagement strategies”. [178] In October 2020, British American Tobacco (Malaysia) unveiled its “Stop The Black Market” bus as part of its commitment to engage Malaysians and draw attention to the seriousness of the black market.[179] British American Tobacco was named as a "Top Employer" for 2019 in eight countries – Australia, Bangladesh, Indonesia, Japan, Malaysia, Pakistan, South Korea and Vietnam, by the Top Employers Institute. [180]

Bangladesh Labor Welfare Foundation (under the Bangladeshi Ministry of Labor and Employment) has received donations amounting to BDT 23,07,61,480 (approximately USD 2 million) from British American Tobacco Bangladesh. Acceptance of these donations was a clear breach of Guideline 4.10, under Article 5.3, of the WHO treaty Framework Convention on Tobacco Control. [181]

Reporting and Regulation

Investigations

New research co-authored by University of Bath details tax avoidance tactics used by the world’s four largest publicly-traded tobacco companies. British American Tobacco and Imperial Brands move large dividends and interest payments to holding companies in the United Kingdom. British American Tobacco moves around UER 1 billion in dividends via Belgium each year but pays less than 1 percent tax on these profits. British American Tobacco and Imperial Brands UK subsidiaries have lowered their corporation tax burden by GBP 2.5-billion over the past decade. They have done this by offsetting losses made by one subsidiary against profit made by another. This is known as group relief. In this way, Imperial Brands was able to lower its UK corporate tax bill by an estimated GBP 1.8-billion over the past 10 years and British American Tobacco by an estimated GBP 760-million. [182]

The US Department of Justice and the Office of Foreign Assets Control are investigating British American Tobacco for “suspicions of breach of sanctions”. It is not clear which country or countries the regulators are focusing on. [183]

A US House of Representatives committee has asked e-cigarette manufacturers to hand over details about the health impact of products, heaping renewed scrutiny on the popular devices. The energy and commerce committee wrote to Fontem Ventures, a subsidiary of Imperial Brands, the tobacco manufacturer, which owns the Blu vaping brand, Reynolds American, the US business of British American Tobacco, Japan Tobacco International and Juul. [184]

According to The Independent, British American Tobacco, Imperial Brands, Japan Tobacco International and Philip Morris International have all shifted their corporate structures to minimise their tax bills in the United Kingdom, researchers from the University of Bath found. Despite being headquartered in Britain, Imperial Brands paid an effective rate of just 13 per cent over the past seven years, during which corporation tax has varied between 20 per cent and 28 per cent. British American Tobacco is also based in the UK but paid “virtually no” corporation tax over the same period, including four consecutive years (2011-14) where it paid nothing at all, the paper found. [185]

Tobacco Litigation

British American Tobacco and Imperial Brands, both based in the UK, denied the allegations of child labor. They asked that the case be dismissed on the grounds that lawyers for the farming families cannot prove the tobacco they grew ended up in their cigarettes and other products. [186]

The Italian Competition Authority said launched an inquiry into British American Tobacco PLC's Italian operations. According to the regulator, three Italian influencers who had a commercial agreement with BAT Italia SpA posted content related to BAT's Glo Hyper tobacco-heating device without disclaiming the promotional nature of the posts. AGCM said the antitrust section of Italy's financial crime investigation unit carried out an inspection at BAT's offices on May 27. [187]

Subsidiaries of British American Tobacco are engaged in on-going legal battles against Philip Morris International in the United States and Romania, claiming the company infringed on patents BAT developed for its vaping products. [188]

The UK Serious Fraud Office has closed a three-year investigation into British American Tobacco over allegations that it bribed government officials in Africa. [189] British American Tobacco sued Philip Morris International in the United States and Germany, alleging that the tobacco heating technology used in IQOS devices infringed its patents. [190]

In August 2018 Uruguay became the first country in the region to enact plain packaging requirements for tobacco products. Only a month later, however, the decree was suspended due to a lawsuit filed by British American Tobacco. An Administrative First Instance Court ruled in favour of British American Tobacco because the plain packaging measure had been enacted by an executive decree instead of a law adopted by Parliament. The Uruguayan government appealed this decision and on 11 October 2018 the Court of Appeal ruled in the government’s favour, although a law would still be necessary to establish plain packaging. A legislative effort was immediately launched that month, leading to the adoption of Law 19.723 on 12 December 2018 and a detailed decree on 29 April 2019, with the law to be implemented for all tobacco products from 22 December 2019. [191]

Human rights lawyers are preparing to bring a landmark case against British American Tobacco on behalf of hundreds of more than 350 children and their families forced by poverty wages to work in conditions of child labor in the fields of Malawi. Leigh Day’s lawyers anticipate the number of child laborer claimants to rise as high as 15,000. While BAT claims it has told farmers not to use their children as unpaid labor, the lawyers say the families cannot afford to work their fields otherwise, because they receive so little money for their crop. [192] British American Tobacco, on its website, says:

  "In the case of tobacco farming, the reality of rural agricultural life in many parts of the world means certain kinds of work can play a formative, cultural, social and familial role for children. Where local law permits, we consider it acceptable for children of between 13 and 15 years of age to help on their families’ farms provided it is light work, and does not hinder their education or vocational training." [193]

In December 2020, a group of tobacco farmers filed a claim in British courts, alleging that years of worker exploitation and child labor violations are among the real reasons for why two tobacco firms have been so profitable. The claims against British American Tobacco, Imperial Brands, and their parent companies and subsidiaries were filled in High Court in London.[194]

Brazil's solicitor general's office is suing British American Tobacco Plc and Philip Morris International to recover the public health treatment costs of tobacco-related diseases over the last five years. [195] This move had been praised by the World Health Organization. [196]

Souza Cruz (a subsidiary of British American Tobacco) was sentenced to pay around USD 180,000 to the widow of a smoker in Caxias do Sul. According to ACT, this is the 1st time that the responsibility of the tobacco industry is recognized. Historically in Brazil, the industry has won all lawsuits filed by victims or relatives. [197] In a lawsuit, filed in the High Court in Auckland, Philip Morris (New Zealand) is suing British American Tobacco (New Zealand), alleging its larger rival is breaching competition law by locking retailers into contracts designed to preserve its dominance in a NZD 2.5 billion market. [198]

In 2015, British American Tobacco, Philip Morris International and Japan Tobacco were ordered to pay CAD 12.5 billion in damages to Quebec smokers. [199]

In 2014, Philip Morris International and British American Tobacco, with support from other companies including Imperial Tobacco and Japan Tobacco International, made a legal bid to have new European Union picture health warnings and a ban on menthol cigarettes overturned. [200]

Angola 2016 Pending BAT Angola affiliate Sociedade Unificada de Tabacos de Angola (“SUT”) was served with a collective action filed in the Provincial Court of Luanda, 2nd Civil Section, by the consumer association Associação Angolana dos Direitos do Consumidor (“AADIC”). The lawsuit seeks damages of AOA 800,000,000 (approximately £2 million or US$2.6 million)

allegedly incurred by the Angolan Instituto Nacional do Controlo do Cancro (“INCC”) for the cost of treating tobacco-related disease, non-material damages allegedly suffered by certain individual smokers on the rolls of INCC, and the mandating of certain cigarette package warnings. SUT filed its answer to the claim on or about 5 December 2016.

Argentina 2007 Evidentiary stage The non-governmental organisation the Argentina Tort Law Association (“ATLA”) and Emma Mendoza Voguet brought a reimbursement action against Nobleza Piccardo S.A.I.C.y.F. (“Nobleza”) and Massalín Particulares. The case is being heard in the Contentious Administrative Court.
Brazil 2007 Subject to further appeal The São Paulo Public Prosecutor’s Office filed a medical reimbursement claim against Souza Cruz S.A. (“Souza

Cruz”). A similar claim was lodged against Philip Morris Brasil Indústria e Comércio Ltda. On 4 October 2011, the Court dismissed the action against Souza Cruz, with a judgment on the merits. The plaintiffs’ appeal to the Court of Appeal failed by unanimous vote (3 to 0). The Public Prosecutor’s Office filed a Special Appeal to the Superior Court of Justice, which was denied on 12 November 2018 by a decision that is subject to further appeal.

Canada NA Following the implementation of legislation enabling provincial governments to recover healthcare costs directly from tobacco manufacturers, ten actions for recovery of healthcare costs arising from the treatment of smoking and health-related diseases have been brought. These proceedings name various Group companies as defendants, including the Company, Investments, Industries, Carreras Rothmans Limited (collectively, the “UK Companies”) and Imperial Tobacco Canada Limited (“Imperial”), the Group’s operating company in Canada, as well as RJRT and its affiliate R.J.Reynolds Tobacco International Inc. (“RJRTI”) (collectively, the “RJR Companies”). Pursuant to the terms of the 1999 sale of RJRT’s international tobacco business to Japan Tobacco Incorporated (“JTI”), JTI has agreed to indemnify RJRT for all liabilities and obligations (including litigation costs) arising in respect of the Canadian recoupment actions. Subject to a reservation of rights, JTI has assumed the defence of the RJR Companies in these actions. The ten cases are proceeding in British Columbia, New Brunswick, Newfoundland and Labrador, Ontario, Quebec, Manitoba, Alberta, Saskatchewan, Nova Scotia and Prince Edward Island. The enabling legislation is in force in all ten provinces. In addition, legislation has received Royal Assent in two of the three territories in Canada, but has yet to be proclaimed into force.

Lobbying

Argentina

Argentina's Tabacalera Sarandi brought the conflict of interest of the President of the Supreme Court, Carlos Rosenkrantz, to justice in a lawsuit against the multinationals Philip Morris (Massalin) and British American Tobacco (Nobleza Piccardo). The Argentine company Tabacalera Sarandi claimed that the President of the Supreme Court Carlos Rosenkrantz has a direction association with Philip Morris (Massalin) and British American Tobacco (Nobleza Piccardo) in the country. The Presidents's daughter, Julia Rosenkrantz is a lawyer for the country's largest law firm, Marval, OFarrell and Mairal, whose historical client is Philip Morris (Massalin). [203]

Australia

Strategic public affairs firm Wells Haslem Mayhew lists British American Tobacco Australia as one of their clients. [204] British American Tobacco Australia wants Western Australia to be the first state in the country to change its e-cigarette regulations. British American Tobacco Australia has fronted WA's Parliamentary Select Committee on Personal Choice and Community Safety, which is assessing whether the use of electronic cigarettes should be made legal in the state. [205] British American Tobacco has previously donated to one of Australia’s most prominent right-wing think tanks Institute of Public Affairs. [206]

Bangladesh

The government of Bangladesh has set the target of making Bangladesh tobacco-free by 2040, while holding a 9.49 percent share in British American Tobacco Bangladesh. [207] A Memorandum of Understanding has been signed between Border Guard Bangladesh and British American Tobacco Bangladesh Company Limited to implement a 'Forestry Project' the Border Guard would be responsible for.[208]

Customs, Excise and VAT Commission suggested British American Tobacco and Japan Tobacco International are under investigation for unfair market advantage.[209]

BAT Bangladesh has been accused of violating tobacco advertising laws by promoting its products ‘indirectly’ through what the company calls “business communication”.[210]

Czech Republic

British American Tobacco proposed an increased excise tax on heated cigarettes in the Czech Republic to at least 80% of the tax rate for conventional cigarettes, a move designed to harm its competitor Philip Morris International. The company supported this step by claiming that there was no evidence to suggest that heated cigarettes are less harmful than conventional tobacco products. [211]

European Union

Think tanks from multiple countries received funding from British American Tobacco, Japan Tobacco International and Philip Morris International, alongside governments as they argued against tobacco controls. [212] According to Politico, among the lobbyists on the EU Transparency Register, representing British American Tobacco are Bernstein Public Policy and Red Flag. [213]

A campaign by Forest EU, funded by Japan Tobacco International, British American Tobacco and members of the European Smoking Tobacco Associations, paints a picture that is out of touch with the reality of EU legislation and the economic and societal effects of smoking in its many forms. [214]

As of May 2021, there are no British American Tobacco-affiliated persons accredited for access to European Parliament premises. Mr Eric Sensi-Minautier is in charge of EU relations. [215]

In 2019, British American Tobacco appeared to have a large lobbying contract potentially worth EUR 500,000 - 599,999 with EUTOP Europe GmbH. [216]

British American Tobacco also used BDL Lobbying Srl for lobbying in 2019 with services worth between EUR 100,000 - 199,999 [217] and Business Platform Europe with services between 10,000 - 24,999 between July 2018 and June 2019. [218].

In 2019, British American Tobacco had an estimated annual cost related to activities covered by the European Transparency Registry in the amount of EUR 2,250,000 - 2,499,999. [215] EU Transparency register lists British American Tobacco as a member of various associations and networks around the world, including: AmCham EU, British Chamber of Commerce Belgium, BusinessEurope, Institute of Economics Affairs (IEA), Kangaroo Group, International Chamber of Commerce UK, INTA, CBI, ICC BASCAP, CECCM (now Tobacco Europe), ESTA, ECMA, CEPS. [215]

A report of a meeting between Director General of the EU's Taxation and Customs Union and British American Tobacco showed how BAT used the findings of a study it commissioned (undertaken by Deloitte/Taj consultants) to support their views against increasing minimum rates in the Tobacco Excise Directive. The study concluded that an increase in rates would unduly affect Eastern European countries, increase illicit trade and vastly increase price elasticity of cigarettes. Furthermore, they argued that the Directive should not be reviewed claiming that there is “no sufficient data” to impose tax regimes on e-cigarettes or heated cigarettes. Similarly, in February 2019, BAT provided the Taxation and Customs Union with its “Analysis of the potential impacts of revising the minimum excise requirements in the European Excise". The study was used to support their key argument that FCT keeps consumers away from illicit, unregulated products, while making it more expensive would push FCT users to illicit products, despite the fact they did not offer any data on the illicit trade of raw tobacco.[219]

Kazakhstan

Kazakhstan’s authorities proposed changes to heated cigarette marketing and packaging regulation in the Eurasian Economic Union. The authorities proposal to the Union included an increase to the size of inscriptions and pictures warning about the dangers of smoking from 50 to 65 percent. The Russian Ministry of Health has also made similar recommendations. [220] According to Forbes Russia, manufacturers disagree with the proposed changes and some sources argue that this step may lead towards halting heated cigarette production in these countries. [221]

Kenya

An employee of a Kenyan PR agency working directly for British American Tobacco offered a bribe to a journalist to leak details of The Bureau’s investigation into how the company had targeted young non-smokers. [222]

Researchers have previously suggested British American Tobacco has undue influence over the Kenyan government and is in breach of the WHO tobacco convention. The company has been accused of intimidation and interference in the country. [223]

In July 2017, the Guardian revealed that in Kenya and Uganda, British American Tobacco sought to prevent the government from taking preventative measures against tobacco. [224] In 2019, the Kenya Tobacco Control Alliance called upon the National Treasury to investigate cigarette manufacturer British American Tobacco alliance over alleged tax avoidance. This followed a report by Tax Justice Network that revealed how British American Tobacco avoids taxes in low and middle-income countries, which is not in line with the World Health Organization recommendations for tobacco taxes to be raised up to 70 per cent. Chief Executive Officer for Consumer International Network, Samuel Ochieng, also mentioned BAT could be increasingly evading taxes since they allegedly bribed policy makers and KRA officials. [225]

Pakistan

In 2018, Philip Morris International Inc and British American Tobacco Plc lobbied Pakistan’s government not to implement larger health warnings on cigarette packs. British American Tobacco, through its local subsidiary, also lobbied then Prime Minister Shahid Khaqan Abbasi with a letter and met Pakistani officials, according to government documents and a review of the October 2017 correspondence. [226]

In 2020 Philip Morris International and British American Tobacco allegedly manipulated a tender process to award a contract for tracing illicit cigarettes to their preferred company.[227]

South Africa

During the Covid-19 pandemic the South African Government posed restrictions on the sale of cigaretes. After the government reneged on its promise to reopen the market under phase 4 of the Covid-19 lockdown regulations [228] British American Tobacco accused the Government of being “unreasonable and maintaining the cigarettes ban for ulterior purposes”. British American Tobacco warned that cigarette sales were likely to fall for the second quarter of 2020, with trade, consumer stocks and revenue growth taking a hit in the country but decided not to take legal action against the government over the ban of cigarette sales after initially saying it would head to court to have the ban overturned. [229]

Japan Tobacco International and British American Tobacco South Africa, together with The South Africa Tobacco Transformation Alliance (SATTA) claim the COVID-19 tobacco sale ban represented an unwarranted and unfair infringement of citizens’ rights. [230]

The Fair-Trade Independent wrote to the South African Revenue Service and Department of Health asking that British American Tobacco be investigated over claims BATSA and some retailers had contravened the Tobacco Act by gifting mobile airtime vouchers.[231]

Switzerland

British American Tobacco invited the press to a meet & greet with the company’s Swiss CEO Mads Larsen and Austrian professor, Bernd Mayer. Mayer spoke about the “benefits of e-cigarettes as an alternative for smokers”. Two parliamentarians were also in attendance.[232]

Uganda

British American Tobacco asked the Ugandan government to lift a ban on e-cigarettes as it sought growth opportunities in a tough business environment. [233]

In July 2017, the Guardian revealed that British American Tobacco in Kenya and Uganda sought to prevent the government from taking preventative measures against tobacco. [234]

Ukraine

In 2019 The Anti-Monopoly Committee of Ukraine fined cigarette manufacturers and distributors, including Philip Morris, JTI Ukraine, Imperial Tobacco, British American Tobacco, as well as the Tedis-Ukraine distributor, who appealed the decision of the Antimonopoly Committee for a fine of UAH 6.5 billion (USD 265 million). The AMCU claimed there was a producers' conspiracy to prevent new potential participants from entering the tobacco distribution market. [235]

United Kingdom

Philip Morris International, British American Tobacco, Japan Tobacco International, Imperial Brands and Juul are all members of the UK Vaping Industry Association (UKVIA), the United Kingdom's leading forum for supporting, developing and promoting the vaping industry. In March 2021, UKVIA issued a wide-ranging report recommending an easing of restrictions covering advertising, packaging and product sizes in the United Kingdom. [236]

The former MP Byron Davies held a reception with British American Tobacco in a parliamentary dining room in November 2016. Craig Mackinlay, a Conservative MP, hosted a roundtable for the Tobacco Manufacturers’ Association in October 2016. [237] CTF Partners, owned by Lynton Crosby, is a registered lobbyist for British American Tobacco on “issues impacting domestic tobacco industry”. [238] 2018 Freedom of information requests revealed that the U.K. Foreign Office and the Department for International Trade had been championing the interests of British American Tobacco in the past. This is despite the government being forced to draw up new guidelines for UK embassy staff after it emerged in 2012 that the UK ambassador had been lobbying the Panama government on behalf of the company. [239]

United States

The California state legislature passed a ban on menthol cigarettes in August 2020, a move that followed weeks of lobbying by British American Tobacco. Menthol cigarettes had represented about a third of the USD 94 billion annual in-country cigarette market, and accounted for 55 percent of Reynolds American's cigarette sales by volume. [240]

Front Groups

British American Tobacco is a Silver member of the Scottish Grocers Federation, a front group 'promoting responsible community retailing by lobbying, communication, networking and advice.' As of 2018, Japan Tobacco International and Imperial Tobacco were both listed as members on the organization's website. [257]

British think-tank Institute of Economic Affairs has carried articles opposing tobacco taxes. While the think tank does not disclose its funding online, Open Democracy and Guardian reported the Institute has received money from British American Tobacco in the past. [258] [259]

Ceylon Tobacco Company is a part of a consortium of multinational corporations in Sri Lanka known as the League of Multinational Corporates. Business Mirror described them as a 'business association that will promote the island nation’s economic potential and initiate a dialogue with the government on the issues and opportunities in the investment landscape.' [260] Managing Director and Chief Executive Officer of the Ceylon Tobacco Company Michael Koest held the chairmanship of the organization as of 2018. [261]

The Eliminating Child Labor in Tobacco-Growing is a front group for tobacco industry interests under the guise of a corporate social responsibility initiative. Eliminating Child Labor in Tobacco-Growing was co-founded by British American Tobacco and represents an alliance of tobacco companies and growers - led exclusively by members of the tobacco industry. In 2016 every member of the board came from tobacco. [262] The Organization has close ties to the United Nation's agency for labor, the International Labour Organization. The partnership has been ongoing since 2002 and seeks to eliminate child labor and promote workers’ rights in tobacco-growing communities in Brazil, Malawi, Tanzania, Uganda and Zambia. [263] In November 2018, the International Labour Organization announced it would no longer rely on tobacco-industry funding for its projects to end child labor and promote workers’ rights in select tobacco growing communities. The International Labour Organization will no longer rely on its public-private partnerships with the tobacco industry to fund projects on addressing child labor and tobacco workers’ rights in the short term. [264] In 2018, Eliminating Child Labour in Tobacco Growing provided training and communications to farmers and rural community members to raise awareness of human rights issues, which reached over 134,000 beneficiaries in 2018. [3]:30

Tobacco Tactics reported a number of tobacco companies, including British American Tobacco were a donors to the Atlas Network in 2015 and 2016. According to Tobacco Tactics' Wiki "internal tobacco industry documents show the Atlas Network has had a longstanding funding relationship with the tobacco industry." [265].
