Imperial Tobacco Group is a British company. It is the fifth largest company participating in the global tobacco market and controls 3.7 percent of the international cigarette market. [1] Imperial operates in more than 160 markets, and key growth markets are in Italy, Russia, Japan, and Saudi Arabia. [2] [3] Top brands include West, Davidoff, John Player Special, and Gauloises. [4] In 2016, Imperial Tobacco was the world’s fifth-largest international cigarette company based on market share. [5]

Company Overview

Imperial Brands is a FTSE 100 company headquartered in Bristol in the United Kingdom. Imperial Brands consists of five distinct entities: Imperial Tobacco, Tabacalera, ITG Brands, Fontem Ventures and Logista. [6]

The core business is built around a tobacco portfolio that offers a comprehensive range of cigarettes (e.g. Davidoff, Gauloises), fine cut (e.g. Drum, Golden Virginia) and smokeless tobaccos (e.g. skruf), papers (e.g. Rizla) and cigars (e.g. Montecristo, Cohiba). Through the Fontem Ventures business, Imperial Brands are also developing a portfolio of brands beyond tobacco, including the e-vapour brand blu. [6]

Executive Committee

Yahoo revealed the company pays its new (2021) male chief executive a bigger salary than his female predecessor. [7] Imperial Brands has decided to cut Chief Executive Officer Stefan Bomhard’s performance-linked pay after shareholders expressed concerns over his remuneration package. The company said Bomhard, who joined as CEO in July last year, and the remuneration committee have agreed that the face value of his 2021 long term incentive plan award will be cut to 315 from 350 percent of his salary. [8]

Stefan has a PhD in marketing and has accrued significant experience in the consumer and retail sectors during his career. Previous roles have included Chief Commercial Officer of Cadbury plc and Chief Operating Officer of Unilever Food Solutions Europe. This followed senior management and sales and marketing positions at Diageo (Burger King) and Procter & Gamble.

Appointment: Appointed to the Board as Chief Executive Officer on 1 July 2020.

Lukas Paravicini Chief Financial Officer Lukas has a proven track record in international consumer goods companies. Beyond his finance credentials, he has considerable operational experience as well as expertise in driving transformational change including in global shared services in large international organisations. Lukas joined Imperial from agricultural commodities and brokerage group ED&F Man Holdings, where he was Chief Financial Officer. He has also held senior positions at Fonterra, a New Zealand and Australia listed co-operative and the world’s largest dairy exporter, with sales in 130 countries. He was Chief Financial Officer from 2013-2017 and Chief Operating Officer, Global Consumer and Foodservice Business from 2017-2018. Prior to that, he spent 22 years with Nestlé in various senior finance and general management roles. [9]
Anindya Dasgupta Chief Consumer Officer Anindya (Andy) has held senior executive roles in Marketing, Strategy and General Management positions in multiple markets, including the USA, India, Singapore, Thailand and the UK. After achieving success in various positions within the consumer healthcare division at GlaxoSmithKline, he joined PepsiCo, where in his 9 year career, he held senior positions culminating in the Global Beverages Group based in New York. He then joined the world’s largest dairy processing company, Fonterra, where he led the Global consumer branded business. Prior to joining Imperial, he was the CEO and Founder of Growth Officers Inc Pte. Ltd., a management consulting firm based in Singapore with operations across South East Asia, Africa and Europe. [9]
Joerg Biebernick Division Director, Returns Joerg has considerable brand marketing and general management experience built during a 25-year career in Europe and the US. Prior to joining Imperial, Joerg served as President, Latin America for Kimberly Clark. He has also held senior positions working in the consumer goods sector for both Georgia Pacific and Procter & Gamble. In addition to managing the Returns Division, Joerg has responsibility for Market Repeatable Model and the Imperial Tobacco brand portfolio. Joerg joined Imperial in November 2017.[9]
Alison Clarke Chief People and Culture Officer Prior to joining Imperial Alison was Chief Human Resource Officer at Inchcape plc, with responsibility for all aspects of people and culture strategies. She is a highly experienced global business leader, having held a number of senior positions at Whitbread, Hutchison and United Utilities. As well as leading a number of large HR functions, Alison has led teams responsible for business transformation, communications and sustainability. Her career also includes time consulting and working with the not-for-profit sector supporting organisational development. Alison is a qualified Executive coach and mentor.[9]
Dominic Brisby Division Director, Growth Dominic leads the Growth Division, which includes selected markets in the EU, Eastern Europe, Asia, and the Middle East and also incorporates the USA and Premium Cigar Division. He previously led the Returns Division. Prior to becoming a Division Director in 2013, Dominic held a number of international general management roles at Imperial and has been responsible for businesses in the Czech Republic, Poland and Iberia. Appointed Growth Division Director in November 2017.[9]
Javier Huerta Group Manufacturing & Supply Chain Director Javier has extensive experience in supply chain, operations and consumer goods, and has overall responsibility for all tobacco and Next Generation Product manufacturing and supply chain operations at Imperial. Prior to joining the business, Javier held a number of senior roles in an 11-year career at Unilever, most latterly as Executive Vice President Supply Chain for Foods and Refreshment. He also held a number of roles over a 14-year period at Nestlé.[9]
Murray McGowan Group Strategy and Transformation Director Murray has a strong background in strategy having worked in various strategic and operational leadership roles for a number of high profile businesses including Costa Coffee (Whitbread), Yum! Brands, Cadbury and The Restaurant Group. He also worked with a range of leading global FMCG and retail businesses during his time at McKinsey & Company.[9]

In January 2019, Morgan Lee was appointed as the group’s market manager for Ireland. [10]

Simon Langelier Non-Executive Director Simon has significant international experience within the tobacco industry. He held a number of senior commercial positions during a 30-year career with Philip Morris International, including in Latin America, Asia, Western and Eastern Europe, Middle East and Africa. In addition, he was President of their Next Generation Products & Adjacent Businesses. Appointed Non-Executive Director in June 2017.

Alan Johnson Non-Executive Director Alan has a strong financial background in consumer goods and retail, having held a number of senior finance positions at Unilever during a 30-year career, including Chief Audit Executive and Chief Financial Officer of the Global Foods Division. He was previously Chief Financial Officer and then a Non-Executive Director at food retailer Jerónimo Martins, SGPS, SA until April 2016.

Committee Membership: Member of the Audit Committee and the Succession & Nominations Committee. External Appointments: President and Chair of the Board of the International Federation of Accountants and a member of the Board and Chair of the Audit Committee of the International Valuation Standards Council.[9]

Sue Clark Senior Independent Non-Executive Director Sue has strong international business credentials with over 20 years’ Executive Committee and Board level experience in the FMGC, regulated transport and utility sectors. Sue held the role of Managing Director of SABMiller Europe and was an Executive Committee member of SABMiller plc. She joined SABMiller in 2003 as Corporate Affairs Director and was part of the executive team that built the business into a top five FTSE company.

Appointment: Appointed Non-Executive Director in December 2018, Chair of the Remuneration Committee in February 2019 and Senior Independent Director on 1 January 2020.

Steven Stanbrook Non-Executive Director Steven brings considerable international executive experience to the Board, gained in a number of FMCG companies. This includes 18 years at SC Johnson & Son Inc., most recently as Chief Operating Officer, where he was responsible for managing their international operations.

Steven is a partner of Wind Point Partners and a Director of both Autism Speaks and The Vollrath Company, LLC. Previously he held senior positions at Sara Lee Corporation, including as Chief Executive Officer of Sara Lee Bakery and at CompuServe Corp. He is also a former Non-Executive Director of Chiquita Brands International, Inc. and Hewitt Associates. Appointed Non-Executive Director in February 2016

John Downing Company Secretary John joined Imperial in 2005 having worked for the law firm Linklaters. He has had a number of senior legal roles in Imperial including playing a leading role in the Altadis acquisition and becoming Head of Group Legal in 2010. He has considerable experience in managing key corporate projects related to financing, business development and other commercial matters. In addition to his Group Company Secretary role, John also has responsibility for the Group's governance, Code of Conduct, security and information security.

Appointment: Appointed Company Secretary in June 2012.[9]

Pierre-Jean Sivignon Non-Executive Director Pierre-Jean is an experienced finance professional, having held Chief Financial Officer positions at Faurecia S.A., a global leader in automotive technology, Philips, the global health technology company, and most recently Groupe Carrefour, the global retailer, where he was also deputy Chief Executive Officer. Having stepped down from executive duties in 2017, he was advisor to the Carrefour Chair and CEO until the end of 2018. He was appointed Non-Executive Director on 1 July 2020.

Jon Stanton Non-Executive Director Jon has a wide range of experience, with a first-class international business track record, including significant US exposure. In 2016 he was appointed Chief Executive of Weir Group PLC, having previously been CFO from 2010. Prior to that he spent 22 years at Ernst & Young, LLP, the last nine years of which were as an audit partner. He was Aapointed Non-Executive Director in May 2019 and Chairman of the Audit Committee in June 2020.

Bob Kunze-Concewitz Non-Executive Director Kunze-Concewitz is an experienced marketing professional and has held a number of senior roles at leading FCMG companies. He has been Chief Executive Officer at Campari Group, a major player in the global spirits industry, since May 2007 having joined the business in 2005 as Group Marketing Director. Prior to his time at Campari Group, he held positions of increasing responsibility at Procter & Gamble, including Global Prestige Products Corporate Marketing Director. [9]

Government Ownership of Philip Morris International

In Lao, the government owns 47 percent of the Lao Tobacco Company. The remaining 53 percent is owned by Imperial Tobacco Group. [12]

Forecast

In February 2021, Imperial Brands laid out a five-year plan, led by its new chief executive Stefan Bomhard, to focus on the company’s top five cigarette markets. [13] Imperial Brands will target cigarette sales in the UK, Spain, Germany, Australia and the US, which make up roughly 72 per cent of profits from combustible tobacco. [14]

Imperial Brands is raising GBP 2 billion through asset sales and has adopted a more flexible dividend policy. [15]

Imperial Brands and British American Tobacco have had GBP 8.6 billion wiped off their stock market value as the United States FDA announcement to crack down on the sale of flavoured e-cigarettes and menthol cigarettes. [16] Imperial reported net revenue increase by 2.2 percent in 2019, driven by growth in tobacco and NGP. [17]

In September 2018, Reuters reported Imperial Brands expects alternatives to smoking such as vaping pens and a heated tobacco device to add up to 1.5 billion pounds to its revenues by 2020. Imperial has estimated the e-cigarette market could exceed USD 30 billion by 2020, up from around USD 4 billion in 2018. [18]

Profitability

In 2019, tobacco net revenue was up 1.1 percent, while total adjusted operating profit declined 2.4 per cent. [19]

According to Imperial's website, Priority Growth Markets are characterised by large profit and/or volume pools with shares below 15 per cent and a real potential for long-term share and profit growth. The website lists the following countries: Italy, Japan, Russia, Saudi Arabia. [20]

Imperial Brands has recently invested in a cannabis-focused biotech company that is researching how compounds in cannabis can be turned into medicine. [28] Imperial Brands signed a CAD 123-million investment deal with Auxly Cannabis Group that includes a research and development partnership. [29] Auxly Cannabis Group announced the closing of a transaction with Imperial Tobacco Group plc in September. Imperial Brands invested CAD 123 million in Auxly. [30]

Tobacco companies have received more than GBP 45 million investment from the United Kingdom's Lincolnshire County Council’s pension fund. The current investment (as of January 2019) for Imperial Brands sits at GBP 4.6 million. [31]

Factory Openings and Closures

In January 2020, Imperial Tobacco announced a proposal to close its cigarette manufacturing facility in Petone, New Zealand. The potential closure follows a review of Imperial Tobacco’s global manufacturing footprint and reflects decreasing production volumes which have led to significant overcapacity. [32]

Imperial Tobacco Group met with Reidsville tobacco manufacturing facility employees in November 2018 to discuss plans to move operations to its Greensboro manufacturing facility. The tobacco company says all of its cigarette production will shift to the company's Greensboro facility by 2020. [33]

Key Portfolio

The company’s tobacco portfolio offers a range of papers and cigars, fine cut, smokeless tobaccos and cigarettes. Through their subsidiary Fontem Ventures, Imperial Brands is also strengthening their range of tobacco free smoking products, including the e-vapour brand blu. The tobacco brands of Imperial Brands are sold in 160 countries worldwide, including the United States where it has a market share of six percent with their ITG brands: Maverick, Winston and Kool, where each of them accounts for some two percent respectively. In January 2020, Imperial Tobacco launched Rizla Flavour Infusions, ahead of the menthol ban next year. The range includes two flavours – Menthol Chill and Fresh Mint – which are packed and wrapped separately so retailers can sell them individually at 25p each. [38]

Heated Tobacco Products

In 2019, overall net revenue of Imperial's 'Next Generation Products' business grew by 48 percent, led by the growth of vapour brand blu in Europe and Japan. Fontem Ventures has plans to make its e-cigarette blu available to smokers in China. [39] [17]:4

A press release sent out on October 3 2018 by ResearchandMarkets.com noted Imperial Brands, in partnership with China National Tobacco, established a joint venture, Global Horizon Ventures Limited (GHVL) focused on long-term earnings potential and competitive position in the growing smokeless tobacco market. [40] Imperial said it will debut its first heated-tobacco product Pulze in Japan. The company predicted that such smoking alternatives may add as much as 1.5 billion pounds (USD 2 billion) in revenue in 2020. [12]

Fontem US LLC, a subsidiary of Imperial Brands Plc, submitted a premarket tobacco application with the U.S. FDA for several styles of its myblu products. [41] In Summer 2018, Imperial launched a product called myblu, in reaction Juul's entry into the US market. [42] Imperial launched the myblu vaping devices into travel retail earlier in 2019 in partnership with Beirut Duty Free and is now planning to roll them out to other regions [43]

A 2014 report by Public Health England revealed that Imperial-owned cigarettes are sold in Lloyds and Boots pharmacies around the United Kingdom. This is against the advice of the Royal Pharmaceutical Society. In 2014, Lloyds Pharmacy began selling Vype and Boots pharmacies began selling Puritane, the e-cigarette brand owned by Imperial tobacco’s subsidiary Fontem. [44] In an investor presentation delivered in March, British American Tobacco said nearly 100,000 Vype devices were sold in Canada in 10 months. [45]

Global Campaigns

Imperial Brands and its affiliated organisations use the following marketing campaigns and partnerships to promote its heated cigarettes (novel and emerging nicotine and tobacco products):

A 2018 investigation uncovered social media advertising campaigns from Imperial Brands reaching millions online, including in the United States. [47]

In 2014, an Imperial Tobacco ad campaign promoting a free-to-download app listing smoking-friendly bars and venues was banned by the Advertising Standards Authority for "normalising" and "condoning" smoking. Imperial Tobacco ran a series of poster ads under the name Smoke Spots, with no indication on the ads that the free app was provided by Imperial Tobacco. [48]

Events

In 2015, World Bank pulled out of the 12th Annual Asia Pacific Tax Forum, which was to be co-organized by a consortium funded by several transnational tobacco companies, including Imperial. [49]

Corporate Social Responsibility

Imperial Tobacco launched a new and improved anti-illicit trade website as part of its ‘Suspect it? Report it!’ trade campaign to "tackle illegal sales of tobacco". [50]

In March 2021, Imperial brands Madagascar has entered into a three-year partnership with the national government to fund the creation, operation and delivery of five large botanical parks. [51]

In May 2019, Imperial conducted a panel meeting of expert facilitators, people development specialists from different stakeholder groups, including retailers, banks, tobacco and vaping consumers, customers, employees, investors, media, non-governmental organisation, tobacco and NGP supplier, non-tobacco material supplier and two experts representing the environment and age-gating certification schemes. The panel meeting resulted in Imperial's Sustainability Strategy. Imperial has identified a number of ESG issues that represent the biggest risks or opportunities for its business: adult choice, business conduct, climate and energy, consumer health, farmer livelihoods and welfare, forestry, health and safety, human rights, illicit trade, recruitment and development, regulation, waste and water. [52]

In May 2014, Guardian reported Imperial Tobacco Group was amongst the companies purchasing tobacco grown in the United States. According to Guardian, these companies current approaches 'did not sufficiently protect children from hazardous work and some companies allow for lower standards of protection for children in their US supply chain than for children working on tobacco farms in other countries'.[53]

Imperial is a board member of the Eliminating Child Labour in Tobacco Growing Foundation (ECLT). [54] A report published in April 2018 by Human Rights Watch said there was widespread child labour in tobacco farms in Zimbabwe, where multinationals including Imperial buy tobacco. [55] The ECLT Board members include: International Tobacco Growers Association; Alliance One International; Altria Client Services; British American Tobacco; Contrax-Nicotex Tobacco; Hail & Cotton; Imperial Tobacco Group; Japan Tobacco International; Philip Morris International; Premium Tobacco; Scandinavian Tobacco Group; Sunel Ticaret Turk; Swedish Match; and Universal Leaf Tobacco. [56] The partnership has been ongoing since 2002 and seeks to eliminate child labour and promote workers’ rights in tobacco-growing communities in Brazil, Malawi, Tanzania, Uganda and Zambia. [57]

In 2015, Imperial Tobacco contributed GBP 57,000 to help tackle the Ebola outbreak in West Africa. [58]

Sponsorship

The PETA International Science Consortium Ltd., Imperial Brands PLC, Altria Client Services, British American Tobacco (BAT) PLC, and Philip Morris International Inc have joined together to donate USD 110,000 worth of equipment that will help to replace the use of animals in respiratory testing with more human-relevant, non-animal test methods. [61]

Imperial Tobacco was one of the sponsors of the 2018 Middle East & Africa Duty Free Association (MEADFA) Conference was held in November 2018under the patronage of H.E. Mr. Saad Hariri, Lebanese President of the Council of Ministers, in Beirut, Lebanon. [62]

Marketing to Kids

A 2018 Campaign for Tobacco-Free Kids investigation into over 100 social media campaigns by Philip Morris International, British American Tobacco, Japan Tobacco International and Imperial Brands revealed tobacco companies pay social media influencers on platforms like Instagram, Facebook and Twitter to advertise their products. [63]

An investigation exposing how tobacco companies market cigarettes on social media around the world revealed Imperial Tobacco products were seen near schools in 22 countries. Despite the findings a spokesman for Imperial Brands said the company ensures:

  "that our product and brand communications are not aimed at, or made appealing to, people under the age of 18 or non-smokers, and that we operate in accordance with local laws”. [64]

In the United States, investigations into Imperial Brands’ efforts to market to kids have uncovered an explosion of sweet flavored tobacco products, especially e-cigarettes and cigars. [65]

Reporting and Regulation

Investigations

New research co-authored by University of Bath details tax avoidance tactics used by the world’s four largest publicly-traded tobacco companies. British American Tobacco and Imperial Brands move large dividends and interest payments to holding companies in the United Kingdom. British American Tobacco and Imperial Brands UK subsidiaries have lowered their corporation tax burden by GBP 2.5-billion over the past decade. They have done this by offsetting losses made by one subsidiary against profit made by another. This is known as group relief. In this way, Imperial Brands was able to lower its UK corporate tax bill by an estimated GBP 1.8-billion over the past 10 years and British American Tobacco by an estimated GBP 760-million. [67]

In August 2019 a US House of Representatives committee asked e-cigarette manufacturers to hand over details about the health impacts of products. The energy and commerce committee wrote to Fontem Ventures, a subsidiary of Imperial Brands, Reynolds American, the US business of British American Tobacco, Japan Tobacco International and Juul. [68]

New Zealand MPs questioned Imperial Brand’s claim that they are not targeting new customers. In an inquiry into smoking in cars, MPs on the Health Select Committee questioned the company's integrity, after an Imperial Brands representative said the company is only looking to transition current smokers to vape products, claiming they are only concerned with "people who have tried absolutely everything and cannot quit." One MP pointed out that the company's website states tobacco maximisation as a core part of its strategy, seemingly contradicting the Imperial Brands’ representative’s claim. [69]

Tobacco Litigation

In December 2020, a group of tobacco farmers filed a claim in British courts, alleging that years of worker exploitation and child labor violations are among the real reasons for why two tobacco firms have been so profitable. The claims against British American Tobacco, Imperial Brands, and their parent companies and subsidiaries were filled in High Court in London.[70]

According to Imperial's 2017 annual report, no tobacco litigation claim brought against the Imperial Group has been successful and/or resulted in the recovery of damages.[2]:27

In February 2018, Dutch prosecutors rejected an attempted murder case brought against the world's largest tobacco companies, including Philip Morris International, British American Tobacco, Japan Tobacco International and Imperial Tobacco by mother with lung cancer. [71]

2006 Italy Imperial Tobacco is currently facing two claims in Italy. The first is against Logista, which is the subject of a challenge on grounds of jurisdiction and the admission of evidence. This challenge was heard in 2006 but judgment is still awaited. The second claim has been brought in the Court of Messina against Imperial Tobacco Italia and Reemtsma by two individuals claiming EUR800,000 in total. We have denied liability. [2]:50
2015 Morocco In June 2015, a claim was filed in the Casablanca Court by the heirs of a deceased individual against our Moroccan subsidiary,

Société Marocaine des Tabacs. The total amount of compensation sought was not specified. On 9 February 2016, the Casablanca Court found in favour of SMT and dismissed the claim. No appeal has been filed. [2]:50

NA Argentina Imperial Tobacco subsidiary, Société Nationale d’Exploitation Industrielle des Tabacs et Allumettes SAS (SEITA), has been notified of a claim filed in the Court of Buenos Aires against Nobleza Piccardo by an individual smoker. Nobleza Piccardo has denied liability. Nobleza Piccardo manufactures and distributes two brands of cigarettes owned by SEITA in Argentina under the terms of a Licence Agreement. Nobleza Piccardo has sought to invoke an indemnity contained in the Licence Agreement, pursuant to which SEITA is responsible for any product liability to third parties. The amount claimed is ARS 8,980,200. The claim is currently in the evidence production period, during which all expert and witness evidence will be produced. [2]:50
2016 Russia In August 2016, a claim was filed in the Russian Court against 18 tobacco companies including JSC Imperial Tobacco Yaroslavl by an individual claiming RUB 523,480,297 and other amounts related to the profits of the defendants. Imperial was notified of the claim by the Russian Court in February 2017. The claim was dismissed in full at a hearing in April 2017. The claimant appealed the decision. The appeal was heard on 18 July 2017 by Moscow Court’s Judicial Panel for Civil Cases. The appeal was dismissed in full and the claimant has until 18 January 2018 to appeal the decision. [2]:50
NA The Netherlands Reports in the public media indicate that a complaint has been lodged with the Public Prosecutor in the Netherlands directed at the four major tobacco manufacturers, including Imperial Tobacco Benelux. Neither Imperial Tobacco Benelux nor any of its employees has been charged by the Public Prosecutor in the Netherlands, but we are monitoring developments. [2]:50
2017 Poland On 9 October 2017, Imperial Tobacco Polska SA (“Imperial Polska”) received notice that a claim has been filed against it in the

Regional Court in Poznań by an individual claiming PLN 1,000,000 by way of compensation for alleged smoking related health effects. Imperial Polska has not yet filed a Statement of Defence but it intends to deny liability. [2]:50

2016 United States A number of smoking and health-related claims have been brought against Imperial Tobacco Group Brands in the state courts. Imperial Tobacco Group Brands has the benefit of an indemnity from another manufacturer in respect of each of these claims. As a result, ITG Brands either has been dismissed, or is expected to be dismissed, without prejudice from each of the claims.[2]:50
2016 United States Imperial Tobacco is currently defending one e-vapour-related claim in the USA. This is a consolidation of two purported class actions (Diek and Whitney) seeking to recover unquantified damages, including punitive damages. A claim that had been brought by the Center for Environmental Health alleging violations of the California Safe Drinking and Toxic Enforcement Act ended. [2]:50

In 2015, tobacco companies including Philip Morris International, British American Tobacco, Japan Tobacco International and Imperial Tobacco Group took the British government to court, arguing that the UK’s “plain packaging” law, unlawfully takes away its intellectual property. [72]

Imperial Brands (majority share owner of Lao Tobacco Company) and Lao-China Hongta Good Luck Company Ltd., violated the law by not printing pictorial health warnings on their cigarette packs. These two companies control over 80 percent of the cigarette market in Lao PDR. [73]

Lobbying

Canada

Imperial Tobacco Canada and JTI Canada Tech, together with Juul Labs Canada have launched the Vaping Industry Trade Association (VITA) with the intention of fighting against proposed government regulations to tighten cigarette regulations amidst the ever increasing number of “vape-related” lung disease cases in the United States. VITA was officially launched in November 2019, and president Daniel David said that the aim is ensuring that regulations aimed at preventing youth access, do not come in the way of adults smokers being able to make use of the devices. [74]

Czech Republic

The Czech Senate is preparing to vote on a disputed tax package, the situation can be abused by the food and tobacco lobby to push its interests. When the Chamber of Deputies passed a tax package last Friday canceling the super-gross wage and increasing the taxpayer's rebate, there was horror. The letter was signed by the CEOs of the Czech branches of British American Tobacco, Imperial Tobacco, Japan Tobacco International and several smaller cigarette importers. [75]

  • The implementation of Directive 2014/40/EU on the approximation of the laws, regulations and administrative provisions of the Member States concerning the manufacture, presentation, and sale of tobacco and related products. [6]
  • Review of Directive 2011/64/EC, on the structure and rates of excise duty applied to manufactured tobacco. [6]
  • Review of Council Directive 2008/118/EC concerning the general arrangements for excise duty and repealing Directive 92/12/EEC [6]

Dustin Dahlman from the German eCig Industry Association was part of a proposed "citizen-led initiative" asking the EU Commission to 'repeal Article 20 of Directive 2014/40/EU and create bespoke legislation which clearly sets vaping products apart from tobacco & pharmaceutical products'. [76]

Between October 2018 and September 2019, Imperial Tobacco had an estimated annual cost related to activities covered by the European Transparency Registry in the amount of EUR 600,000 - 699,999.

In 2017, Fontem Ventures, affiliated with Imperial Tobacco used the services of Aspect Consulting for lobbying in Brussels [77] and Blue Star Strategies globally. [78]

Lao

Lao PDR’s joint venture agreement with Imperial Brands gives preferential treatment to the tobacco industry. This lopsided 25-year agreement grants a tax rate of 15 percent if production costs are less than LAK 1,500 per pack of 20 units and 30 percent if production cost is more than LAK 1,500 per pack of 20 units. This agreement caused the government to lose about USD 144 million in tax revenues between 2002-2017. Additionally, no action has ever been taken against Imperial Tobacco for non-compliance with the pictorial health warnings on its packs. [79]

United Kingdom

Philip Morris International, British American Tobacco, Japan Tobacco International, Imperial Brands and Juul are all members if the UK Vaping Industry Association (UKVIA), United Kingdom's leading forum for supporting, developing and promoting the vaping industry. [80]

Ukraine

Two years after Ukraine’s antitrust agency gave big tobacco with a record $256 million in fines, the state budget will not be adding anything to its coffers. On June 1, the Supreme Court of Ukraine, the country’s highest judicial body, ruled that allegations Imperial Tobacco Ukraine had acted in violation of anti-monopoly legislation were groundless, overturning the $17 million fine imposed by the Anti-Monopoly Committee of Ukraine. [81]

The website TobaccoTactics, offers an updated list of organizations Imperial Tobacco was a member or supporter of in 2017. The Austrian Public Affairs Association website lists Hanna Friedl and Jared Wiener from Imperial Tobacco Austria as members. [82]

Imperial Tobacco is a Gold member of the Scottish Grocers Federation, a front group 'promoting responsible community retailing by lobbying, communication, networking and advice.' As of 2018, British American Tobacco and Japan Tobacco International were both listed as members on the organization's website. [83]

Politics

Scottish National Party accepted conference fees from Japan Tobacco International and Imperial Tobacco. Both companies were at the SNP Party Conference after buying "business day" passes advertised at GBP 1,750 each. [84]

In 2010, European Commission announced a multi-year agreement with Imperial Tobacco to work together in tackling the illicit trade in tobacco products. Under the legally binding agreement, ITL will work with the European Commission, its anti-fraud office OLAF, and Member States’ law enforcement authorities to help in the fight against contraband and counterfeit cigarettes. The Agreement included a USD 300 million contribution (over the next 20 years) by Imperial Tobacco. [85]
